File a Complaint

To file a complaint against a company that you feel has engaged in unlawful or unethical practices, use the membership directory to determine if the company is a member of this organization.

  • 1.   If the company is not a member, TMBA cannot accept your complaint here. We have no authority or compliance requirements for companies that are not members of our organization. Use the TDFI resource page for the agencies and processes for filing complaints against non-TMBA member companies.
  • 2.   If you have a complaint against a mortgage company that is a member of the TN Mortgage Bankers Association for any business practice you believe is unethical or illegal and a possible violation TMBA Code of Ethics, we recommend the following available options.

First, contact the loan officer immediately and explain your concerns.Second, if the loan officer cannot or will not correct the problem to your satisfaction, call or write the company and explain the situation and outline the steps you would like to see taken.If the company does not resolve your problem and it is a member of the TN Mortgage Bankers Association, you may wish to file a complaint with us.To file your complaint please send us a written letter detailing the complaint. Submit your information to TMBA’s Executive Director who will send the matter for investigation and contact you directly. To submit your complaint writing, you may mail or fax it to the address below. Your complaint should include the following basic information:

  • -   The date and details of the incident
  • -   The parties involved
  • -   If possible, identify the Code violation you believe has occurred
  • -   Efforts you have made to resolve the matter
  • -   List the subject documents, disclosures or other supporting documents
  • -   Any responses the other parties have made to resolve the matter
  • -   The current status of the complaint
  • -   How you would like to see the complaint resolved or remedied

The Executive Director is independent, and not affiliated with any mortgage company of the TN Mortgage Bankers Association. The ED will do everything possible in accordance with the procedures of the Cannons and Codes to resolve the problem to the satisfaction of all parties. A copy of the complete cannons and codes is available on this website. The Board of Directors is empowered to determine appropriate remedies and TMBA member companies have agreed to be bound by the Board’s decisions.
